Purchaser agrees to the following:
1.
To tender full purchase price before delivery of cat by cash,

2.
I will exercise due care and diligence in providing for the maintenance
of this cat/kitten including but not limited to regular veterinary check-ups, vaccinations, sound nutrition and a comfortable and safe environment.
I will not allow this cat/kitten to run free outdoors. I
further agree not to keep this cat/kitten caged on a permanent basis. In
the case of a male, I agree that he will not be confined to an enclosure that is
less than a 24 sq.ft. area and that he will be given ample time daily for proper exercise and human companionship.
3.
If unforeseen circumstances
make it impossible for me to keep this cat/kitten, I agree to advise Seller immediately. I agree
that this cat/kitten will never be sold, leased or given to another breeder
without the Seller’s full written approval of the new buyer/owner before
completing an agreement of transfer of ownership.
4.
Under no circumstances will this cat/kitten be sold, or given to any pet
shop, research laboratory, or abandoned or placed in an animal shelter or
similar facility.
5. I will breed this cat only to cats that I have full ownership of, residing in my cattery.
6.
If this cat/kitten is show quality I have Seller's consent to
exhibit in championship or premiership to attempt to secure its championship and
grand championship. I agree that
the cat will be exhibited only if it is in good condition and proper coat.
7. I
agree that loss or injury of this cat/kitten during shipping will be borne by me. I agree to call
Seller immediately upon receipt of this
cat/kitten. At this time, any
questions regarding the quality or health of this cat/kitten will be discussed.
I will isolate this cat/kitten If I have other pets to protect the health
of the cat/kitten until those questions are resolved.
8.
If I return this cat/kitten to Seller for any reason, I
will pay all shipping charges. I agree that I am responsible for this cat/kitten and
its value until it is received in good health by the Seller.
Any loss or injury sustained by this cat/kitten is my liability and I
have been advised to obtain proper insurance.
9. If I return this cat/kitten to Seller for any reason, I agree to provide a veterinary certificate stating that the cat/kitten does not have ringworm or mites and to have the cat/kitten tested for feline leukemia and FIV within one-week prior to return to Seller at my expense. Seller will be advised of those test results prior to shipment and has the right to delay shipment. This is in the event that test results are not within the range considered safe to return the cat/kitten to the cattery and risk endangering Seller's cats.
10. I agree that this cat/kitten will not be declawed.
11. I agree that I will not sell any first generation kittens from
this cat to breeders residing in the United States or
Canada. If I am a resident of the United States or Canada I may sell first
generation kittens overseas only with Seller's approval.
12.
If any dispute arises under this
contract/agreement, I consent to submit to the jurisdiction of the
county/province of the residence of the Seller at the time such dispute arises.
I further agree to accept service of process by certified or regular
mail.
2. I agree that upon full payment I will tender to Purchaser a true and correct pedigree and the necessary papers to register the cat in Purchaser’s name in CFA or TICA.
3.
I guarantee that the cat/kitten described above is in good health at the time
of purchase and a veterinary certificate to this effect will be provided prior
to shipping. If
examination by a licensed veterinarian within 72 hours of shipping or personal
pick-up by Purchaser
reveals otherwise, a cat/kitten of equal quality will be provided, when
available, or a full refund of monies paid for the cat/kitten will be provided.
If the cat dies within the first two years of a genetic health defect,
prior to Purchaser having bred the cat and sold any offspring, I will replace the cat for
one of equal quality upon availability basis and upon receipt of a detailed necropsy
report by a Veterinarian outlining the alleged health defect. Any shipping and
incidental expenses incurred in returning the cat is the responsibility of the
Purchaser. This guarantee does
not include the common sniffles and/or problems arising from change of food
& water that are associated with a change in environment.
Seller has the right to request a second opinion from a Veterinarian of the
Seller's choice, at the Seller's expense.
It is further agreed that any modifications or changes made to this Contract must be in
writing and signed by both parties in order to be considered valid.
If
any terms of this contract are broken, Purchaser will be fined $2,000 for breach
of contract.
I agree
