Purchaser agrees to the following:

1.         To tender full purchase price before delivery of cat by cash, certified cheque, money order or as otherwise agreed below:

2.         I will exercise due care and diligence in providing for the maintenance of this cat/kitten including but not limited to regular veterinary check-ups, vaccinations, sound nutrition and a comfortable and safe environment.  I will not allow this cat/kitten to run free outdoors.  I further agree not to keep this cat/kitten caged on a permanent basis and will give ample time daily for proper exercise and human companionship.

3.           If unforeseen circumstances make it impossible for me to keep this cat/kitten, I agree to advise breeder/seller immediately.  I agree that this cat/kitten will never be sold, leased or given to another breeder without the seller’s full written approval of the new buyer/owner before completing an agreement of transfer of ownership.  I will breed this cat only to cats that I have full ownership of.

  4.         If this cat/kitten is show quality I have the breeder’s consent to exhibit in championship or premiership to attempt to secure its championship and grand championship.  I agree that the cat will be exhibited only if it is in good condition and proper coat.

  5.        I agree that risk of loss or injury during shipping will be borne by me (the purchaser).  I agree to call seller immediately upon receipt of this cat/kitten.  At this time, any questions regarding the quality or health of this cat/kitten will be discussed.  I will isolate this cat/kitten If I have other pets to protect the health of the cat/kitten until those questions are resolved.

7.         If I return this cat/kitten to seller for any reason, I will pay all shipping charges and that I am responsible for this cat/kitten and its value until it is received in good health by the seller.  Any loss or injury sustained by this cat/kitten is the purchaser’s liability and the purchaser has been advised to obtain proper insurance.

8.         If I return this cat/kitten to seller for any reason, I agree to have this cat/kitten tested for feline leukemia and FIV within one-week prior to return to seller at buyer’s expense.  Seller will be advised of those test results prior to shipment and has the right to delay shipment. This is in case test results are not within the range considered safe to return to the cattery and reside with our cats until re-testing and/or an agreeable situation can be arranged.

9.          I agree that this cat/kitten will not be declawed. 

10.         Under no circumstances will this cat/kitten be sold, or given to any pet shop, research laboratory, or abandoned or placed in an animal shelter or similar facility.

11.         If any dispute arises under this contract/agreement, I consent to submit to the jurisdiction of the county/province of the residence of the seller at the time such dispute arises.  I further agree to accept service of process by certified or regular mail.

  Seller agrees to the following:

  1.         I warrant that I have good and legal title to the above described cat/kitten and I will tender the cat for delivery upon receipt of full purchase price by the buyer weather permitting.

2.         I agree that upon full payment I will tender to purchaser a true and correct pedigree and the necessary papers to register the cat in the purchaser’s name in CFA.

3.         I guarantee that the cat described above is in good health at the time of purchase.  If examination by a licensed veterinarian within 72 hours of possession reveals otherwise, I will replace the cat with one of equal quality or refund half the cost of the cat to the purchaser.  If the cat dies within the first two years of a genetic health defect, I will replace the cat for one of equal quality upon availability basis upon receipt of a detailed necropsy report by a Veterinarian outlining the alleged health defect. Any shipping and incidental expenses incurred in returning the cat is the responsibility of the buyer.   This guarantee does not include the common sniffles and/or problems arising from change of food & water that are associated with a change in environment.   The cat has been immunized against panleukopenia, rhinotracheitis and calici virus.  If FeLV, FIP or Chlamydia vaccines are given, it will be at the responsibility of the Purchaser.

The breeder has the right to request a second opinion from a Veterinarian of the breeder’s choice, at the breeder’s expense.

It is further agreed that any modifications or changes made to this Contract must be in writing and signed by both parties in order to be considered valid.

If any terms of this contract are broken, Purchaser will be fined $2,000 for breach of contract.
